Truth & Defiance – Terms of Service

Effective date: December 8, 2025 By using TruthAndDefiance.com (the “Site”), you agree to these Terms of Service. If you do not agree, please do not use the Site.

1. Who we are

Truth & Defiance is an independent art-led streetwear brand operated by Astrid Stark (“we,” “us,” “our”). The Site includes our store, The Backbone membership site, the Vault, and the Striid Underground blog.

2. Using the site You agree to:

• Use the Site only for lawful purposes.

• Not try to damage, hack, or disrupt the Site.

• Not copy, resell, or exploit any part of the Site or its content. We may change or discontinue any part of the Site at any time.

3. Orders and payments

• Prices, products, and availability can change without notice.

 • An order is accepted only when we email you a confirmation.

• We may cancel or refuse any order (for example, suspected fraud or stock issues).

• You agree to provide accurate billing, shipping, and contact information. Shipping, returns, and refunds are governed by the policies posted on the Site at the time of your purchase.

4. The Backbone membership

• Membership is for personal use only and may not be shared or resold.

 • We may change, pause, or end membership features at any time.

• Unless required by law, membership fees are generally non‑refundable.

5. Intellectual property

All artwork, characters, graphics, photos, designs, logos, and text on the Site are owned by Truth & Defiance or used with permission. You may not use, copy, or distribute them for commercial use or monetary gain without our written consent.

6. User content If you submit reviews, comments, or other content, you:

• Promise you have the right to share it.

• Give us permission to use, copy, and share it for marketing or other purposes.

• Agree not to post anything illegal, abusive, or infringing on others’ rights. We may remove any content at our discretion.

7. No warranties

The Site and all products and services are provided “as is” and “as available.” To the fullest extent allowed by law, we make no warranties about:

• The accuracy or completeness of content.

• The Site being error‑free or always available.

• Products meeting your personal expectations.

8. Limitation of liability

To the fullest extent allowed by law, we are not liable for:

• Any indirect, incidental, or consequential damages.

• Loss of profits, data, or business opportunities. If we are found liable for anything related to the Site or your purchases, our total liability will not exceed the amount you paid us for the product or membership involved.

9. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, or costs (including legal fees) arising from your use of the Site, your violation of these Terms, or your infringement of any rights of another person.

10. Third‑party services

The Site may link to third‑party sites or use third‑party services (such as payment processors). We are not responsible for their content, policies, or actions. Your use of them is at your own risk and subject to their terms.

11. Changes to these Terms

We may update these Terms from time to time. The “Effective date” will change when we do. Your continued use of the Site after changes means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the State of Alaska, USA. Any disputes will be handled in state or federal courts located in Alaska, unless applicable law requires otherwise.

13. Donations and Tips to the Artist

The Site may allow you to send voluntary monetary “donations,” “tips,” or similar contributions directly to the artist/founder (for example, to support art, content, or community projects).

 • Donations are completely voluntary and do not purchase any product, membership, or service.

• Unless we clearly state otherwise in writing, donations are non‑refundable and are treated as personal support to the artist, not as tax‑deductible charitable gifts. You are responsible for any tax questions related to your donations.

• We may show general information about donation activity (for example, total raised for a project), but are not required to display individual donor names or amounts.

• We reserve the right to refuse, limit, or return a donation if we suspect fraud, abuse, or violation of these Terms.
